Distinguished Stays Terms & Conditions
Please read your Rental Property Agreement carefully before you begin your vacation. Any monies received by Distinguished Stays for occupancy of Vacation Property indicate the acceptance of the terms of our Rental Property Agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

RENTER REQUIREMENTS
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is the Guest. All other persons involved with the rental are the Guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the Guest, not the Guest's invitees. The Guest understands that Distinguished Stays rents to responsible adults over the age of 18 ONLY.

DOWN PAYMENT/ PAYMENT TERMS
Reservations of less than 28 days:
Reservations shorter than 28 days can be made with a 50% down payment paid by credit card when the reservation is made. Full balance is due 30 days prior to the scheduled arrival date.  Balance will be charged to the credit card on file.  Guests are responsible to make payment arrangements if this charge does not occur. If a reservation is made less than 30 days prior to arrival, full payment is due when the reservation is made. The credit card must have an expiration date that extends beyond the stay.  A $35.00 service charge will be incurred for any returned checks.
Reservations of 28 days or longer:
A reservation for 28 days or more can be made with a payment for the full first month paid by credit card when the reservation is made. After check-in, payment is due monthly for the duration of the reservation beginning one month after check-in.  Payments will be charged to the credit card on file.  Guests are responsible to make payment arrangements if these charges do not occur.  The credit card must have an expiration date that extends beyond the stay. 

DAMAGE POLICY
As a condition to the rental of all our properties, Distinguished Stays reserves the right to charge the Guest’s credit card for any and all uncovered Guest/Invitee caused losses and damages sustained to the Rental Property throughout the duration of their period of occupancy. In the event of any Guest/Invitee-caused loss or damage to the Rental Property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, neighborhood disturbances, repairs or replacements, plus, all applicable taxes, Distinguished Stays is hereby granted the right to charge the Guest's credit card. An itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked. By written or electronic endorsement of this Agreement, the Guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.

UPON ARRIVAL
Guest agrees to inspect the property immediately upon arrival. If there are concerns or issues with the rental property, Guest must contact our team immediately at 512-649-3000 or Hello@DistinguishedStays.com. No refunds or considerations are given unless we are promptly notified of problems during the stay. Guest must document any pre-existing damage upon arrival in order not to be held responsible.

EMERGENCIES/ MAINTENANCE
In the event of a problem getting in the property or if there are problems with the condition or functionality of the property, please immediately contact the Distinguished Stays office at 512-649-3000 and Hello@DistinguishedStays.com. If it is after office hours, we will make every effort to reply as soon as possible. It is important to leave a message if there is no answer.

ARRIVAL TIME
Check in is any time after 4 pm. If an early check-in is requested, we will make every effort to accommodate if possible, but check-in prior to 4 pm is never guaranteed. Unless Guest has specifically arranged for an early arrival time, Guest agrees not to arrive at the property before the scheduled check in time.

DEPARTURE TIME
Check out is at 11 am. Guest’s prompt departure is required in order to prepare the property for incoming guests. Because a late check out can disrupt other guest's plans and become costly, Guest may incur charges if not checked out by 11 am. If Guest has not checked out of the property by 12 noon on the day of check-out without permission from our team, Guest agrees to pay up to $250 plus 2.5 times the daily rate for the reservation, plus $85 per hour until check-out is complete.

CANCELLATIONS
When a non-refundable option is offered for a discount and Guest selected a non-refundable booking, no refunds will be given for cancellations or rescheduling. On standard bookings, we offer a full refund when a cancellation or rescheduling is requested at least 14 Days prior to check-in. We offer a 50% refund when a cancellation or rescheduling is requested at least 7 Days prior to check-in. No refund will be given when a cancellation or rescheduling is requested less than 7 days prior to check in.

POWER/ WEATHER RELATED CANCELLATION
Distinguished Stays will  not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires. If the property is uninhabitable due to such circumstances, reservations can be rescheduled for future dates within one year of the reservation date.

CHANGE IN NUMBER OF GUESTS/CONDUCT OF GUESTS
Guest agrees that the number of people stated on the reservation shall not be exceeded on the premises. Guest agrees to inform us of any change in the number of guests before arrival so the property can be prepared appropriately, and to avoid potential charges.  Unauthorized people on the property at any time will result in a double charge for each additional guest and may result in other charges. The rental is neither intended for parties or gatherings at any time excepting those that have paid to occupy the property. Exceptions are made on an individual basis but must be requested in advance. Guest agrees to follow the House Rules and Manual for the property.  We take being a good neighbor seriously and do not tolerate disruption of our neighbors.  Firearms are not allowed on our properties without prior approval, and discharging of firearms is never allowed on our properties.  If there is excessive noise/music, illegal activity, or evidence of violation of these policies, Guest agrees to vacate the premises when requested immediately, without refund, and to pay additional charges that may be assessed. Guest agrees to pay for any and all damage, disturbance, cleaning charges and any cost incurred as a result of the violation(s).  

CLEANING FEE(s)
A non-refundable cleaning fee is required with all reservations. Guest(s) are required to follow all check out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the property shall be charged to the Guest's/Cardholder's credit card as an Additional Cleaning Charge.  This includes, but is not limited to the property interior, furnishings, appliances, exterior, grounds, BBQs, pools and hot tubs (if so equipped).  Additional charges may be referenced in the House Rules and Manual. 

NOTICE OF MAINTENANCE REQUIREMENTS
Guest agrees to contact Distinguished Stays immediately if something doesn’t look right or the property requires repair/maintenance.  This includes, but is not limited to plumbing leaks, landscape or sprinkler malfunction, inoperable items, damage of any kind, pool or hot tub not filled, plants dying, etc.  Guest understands that ongoing maintenance may be completed at the property during the stay, and such maintenance may temporarily disrupt their use of the property.  Examples are landscape maintenance, pool/ spa maintenance, and pest control services, as applicable.  Guest understands that no compensation or refunds are issued if Guest is impacted by required maintenance.

LINENS & TOWELS
Bath towels, sheets, pillows and blankets are provided. We also provide outdoor towels where appropriate. DO NOT take the property’s linens or towels outside other than designated outdoor towels. Extra sheets and towels are provided if you are staying a week or longer (otherwise one set per guest is provided).

SMOKING
Smoking is NOT permitted in any Distinguished Stays property. Smoking is allowed outside, as permitted by law, and if butts and ashes are not left behind. Do not throw butts on the ground or bring them into the unit. If there is any tobacco smell in the unit after your departure, there will be a minimum $250 charge. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning.

PLUMBING
Guest agrees not to put feminine products or trash in the toilet. Plungers are provided if a clog occurs. Guest agrees not to pour grease down the drain.

SATELLITE TV, INTERNET & PHONE CALLS
All properties are privately owned and have different subscription packages for cable and/or satellite and internet. Distinguished Stays does not guarantee any programs, events or reception. Guest is liable for any content ordered through apps or pay-per-view. If Guest(s) does not use their own credit card for ordering, programming charges plus an additional $7.00 processing fee will be charged to the credit card we have on file.

PETS
Pets are only permitted on select Distinguished Stays properties and pet policies including pet fees and rent must be followed.  Guest agrees not to bring undisclosed pets onto property.  Guest is responsible for their pet and agrees to pay pet fees, pet rent, and any damages.

LEFT ITEMS
Please check carefully for belongings before you leave. Left items can be mailed to you if requested and you will be charged shipping costs to the credit card on file. Distinguished Stays are not responsible for lost or stolen items.

RIGHT OF ENTRY
Guest(s) agree that Distinguished Stays reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or to show the property to prospective purchasers or guests (in which case prior notification will be given).

INDEMNIFICATION & HOLD HARMLESS
While DISTINGUISHED STAYS and its Property Managers/Owners strive to maintain its Rental Properties in the finest condition, no guarantees are expressed or implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Rental Property structures and premises at their own risk. DISTINGUISHED STAYS and its Property Manager/Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs, saunas, pools, games, sports equipment, exercise equipment, bicycles, kayaks and any other floatation devices, docks, boat storage devices, bunk beds, BBQs and any other included equipment of any kind) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Rental Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Rental Property and/or its contents. DISTINGUISHED STAYS and its Property Managers/Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Rental Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify DISTINGUISHED STAYS and its Property Managers/Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.

SIGNATURE
Please sign and return this page of this agreement via fax, email or mail ONLY IF you made reservations by phone. If reservations were made online, you’ve already agreed to our policies and no signature is required.

“I authorize Distinguished Stays to charge the card I’ve provided for any additional requested rental expenses incurred, and to pay for those damage or excessive cleaning expenses incurred that are not covered for reimbursement under the Vacation Rental Damage plan. I also hereby confirm that the number of guests will NOT be more than stated in this agreement at any time and that violation of this policy will result in this credit card being charged maximum occupancy or double the guest fees, whichever is greater.”
